By accessing or using 9x12 Pro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
9x12 Pro is a business management platform designed for operators of 9x12 postcard advertising co-ops. The Service is provided by 10kpostcards ("we," "our," or "us").
2. Description of Service
9x12 Pro provides tools for managing postcard advertising businesses, including:
- Prospect search and lead management
- Client relationship management (CRM)
- Postcard design and campaign tracking
- Sales pipeline and deal management
- Financial tracking and revenue management
- Contact enrichment and data scraping
- Integration with third-party services (Google Maps, Facebook)
3. User Accounts
3.1 Registration
To use 9x12 Pro, you must create an account by providing accurate and complete information. You may register using email or Facebook Login.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
3.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.
4. Subscription and Payment
4.1 Pricing
9x12 Pro offers subscription plans with monthly billing. Current pricing:
- Free Plan: $0/month (1 campaign, 1 ZIP code, 500 enrichments/month, basic CRM)
- Pro Plan: $49/month early-bird rate (regular $79/month) — 3 campaigns, 10 ZIP codes, 15,000 enrichments/month, 1,000 email sends/month, facing slips, full CRM
- Enterprise Plan: $99/month early-bird rate (regular $139/month) — unlimited campaigns, ZIP codes, enrichments, email sends, priority support
4.2 Billing
- Subscriptions are billed monthly in advance
- Payment is processed automatically via Square
- You authorize us to charge your payment method on file
- Prices may change with 30 days notice (grandfathered rates excluded)
4.3 Cancellation and Refunds
- You may cancel your subscription at any time
- Cancellations take effect at the end of the current billing period
- No refunds for partial months
- Free trial: Cancel anytime during trial period with no charge
5. Acceptable Use Policy
5.1 Permitted Use
You may use 9x12 Pro only for lawful business purposes related to operating a 9x12 postcard advertising business.
5.2 Prohibited Activities
You may NOT:
- Use the Service for spam, harassment, or illegal marketing
- Scrape or export data for resale or use outside the platform
- Reverse engineer, decompile, or attempt to extract source code
- Share your account credentials with others
- Use the Service to violate privacy laws (GDPR, CCPA, CAN-SPAM, etc.)
- Overload our servers with automated requests (rate limits apply)
- Upload viruses, malware, or malicious code
- Impersonate another person or business
6. Data and Privacy
6.1 Your Data
You retain ownership of all data you enter into 9x12 Pro (prospects, clients, campaigns, designs, etc.). We do not claim ownership of your business data.
6.2 Our Use of Data
We may use aggregated, anonymized data to improve the Service and develop new features. See our Privacy Policy for details.
6.3 Data Deletion
You may export or delete your data at any time. See our Data Deletion Instructions.
7. Third-Party Services
9x12 Pro integrates with third-party services:
- Google Maps API: For location-based prospect search
- Facebook Login: For authentication
- Supabase: For database hosting
- Vercel: For application hosting
- Square: For payment processing
Your use of these services is subject to their respective terms of service and privacy policies.
8. Intellectual Property
8.1 Our IP
9x12 Pro, including all software, design, text, graphics, and trademarks, is owned by 10kpostcards and protected by copyright, trademark, and other intellectual property laws.
8.2 License Grant
We grant you a limited, non-exclusive, non-transferable license to use 9x12 Pro for your business purposes during your subscription period.
8.3 Your Content
By uploading postcard designs or other content, you grant us a license to store, display, and process that content solely to provide the Service to you.
9. Disclaimers and Limitations of Liability
9.1 "As Is" Service
9x12 Pro is provided "as is" without warranties of any kind, express or implied. We do not guarantee:
- Uninterrupted or error-free operation
- Accuracy of data from third-party sources (Google Maps, web scraping)
- Compatibility with all devices or browsers
- That the Service will meet your specific business needs
9.2 Data Accuracy
Important: Lead scoring, enrichment data, and business information are provided for informational purposes only. We do not guarantee:
- Accuracy of phone numbers, emails, or social media links
- Validity of lead scores or "hot lead" classifications
- Completeness of prospect data
You are responsible for verifying all information before contacting prospects.
9.3 Limitation of Liability
To the maximum extent permitted by law, 10kpostcards shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Lost profits, revenue, or business opportunities
- Data loss or corruption
- Damages resulting from use of third-party services
Our total liability shall not exceed the amount you paid in the last 12 months.
10. Indemnification
You agree to indemnify and hold harmless 10kpostcards from any claims, damages, or expenses (including attorney fees) arising from:
- Your violation of these Terms
- Your violation of applicable laws (CAN-SPAM, privacy laws, etc.)
- Your use of prospect data obtained through the Service
- Claims by third parties related to your marketing activities
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the new Terms on this page
- Updating the "Last Updated" date
- Sending an email to your registered address (for major changes)
Your continued use of 9x12 Pro after changes constitutes acceptance of the new Terms.
12. Service Availability
We strive for 99.9% uptime but reserve the right to:
- Perform scheduled maintenance (with advance notice)
- Make emergency repairs or updates
- Temporarily suspend service for security reasons
We are not liable for service interruptions beyond our control (hosting provider outages, DDoS attacks, etc.).
13. API Rate Limits
To ensure fair usage, we enforce rate limits:
- Free Plan: 1 ZIP code search, 500 enrichments per month
- Pro Plan: 10 ZIP code searches, 15,000 enrichments per month, 1,000 email sends per month
- Enterprise Plan: Unlimited searches, enrichments, and email sends
Exceeding limits may result in temporary throttling or upgrade prompts.
14. Governing Law
These Terms are governed by the laws of the jurisdiction where 10kpostcards is registered, without regard to conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these Terms or your use of 9x12 Pro shall be resolved through:
- Good faith negotiation between parties
- Mediation (if negotiation fails)
- Binding arbitration (as a last resort)
16. Entire Agreement
These Terms, together with our Privacy Policy and Data Deletion Instructions, constitute the entire agreement between you and 10kpostcards regarding 9x12 Pro.
